Federal court finds California's death penalty unconstitutional SAN FRANCISCO – (INT) – California will appeal a federal district court decision that found the state’s death penalty unconstitutional.
Thursday’s decision was on the theory that it takes too long for courts to consider and rule on defendants’ challenges to their convictions and sentences. State Attorney General Kamala Harris said the court’s ruling is not supported by law “and it undermines important protections that our courts provide to defendants.” She said in a written statement.
